Measures of Liwan District of Guangzhou Municipality for Further Promoting the Development of High-Quality Enterprises

Article 1. [Purposes and Basis] These Measures were developed based on the situation in Liwan District to promote and safeguard the sustainable development of enterprises in Liwan District, attract high-quality projects, regulate the administration of enterprises, provide enterprises with a good environment under the rule of law and high-quality and efficient services, further create a favorable business environment for enterprises, and encourage all sectors of the community to engage in the attraction of investments.

Article 2. [Administration Responsibilities] These Measures are led, organized, and enforced by the district departments of commerce and investment promotion. Other departments of the District Government shall cooperate and assist in the implementation within the scope of their responsibilities.

Article 3. [Applicability] Unless otherwise specified, these Measures apply to high-quality enterprises that have their business registration and tax payments made in the administrative jurisdiction of Liwan District, have an independent and sound financial management system, practice independent accounting, have comprehensive strength, industrial efficiency, and considerable potential, conform to the guidance of the industrial development direction of Liwan District, and benefit the industrial development of Liwan District to a certain extent (with the exception of real estate project companies).

Article 4. [Enterprise Introduction Reward] It is encouraged to introduce enterprises that have a Global 500 company as their parent company, head office, controlling shareholder, or de facto controller, and serve as the highest-level organizations of such a company in the municipality. It is encouraged to introduce enterprises that have a large central state-owned enterprise (group) or one of China’s Top 500 Enterprises, China’s Top 500 Private Firms, China’s Top 500 Manufacturing Enterprises, or China’s Top 500 Service Enterprises as their parent company, head office, controlling shareholder, or de facto controller, and serve as headquarters or regional headquarters in Liwan District. Among such newly introduced enterprises, each of those that are included in the statistical management as enterprises above the designated size in the year of business registration shall be awarded 1.5 million RMB in a lump sum. Those that are included in the statistical management as enterprises above the designated size one year after the year of business registration shall be awarded 1 million RMB in a lump sum.

Article 5. [Enterprise Growing Reward] An enterprise, which is newly included in the statistical management as enterprises above the designated size, shall be awarded 50,000 RMB in a lump sum.

A foreign-funded enterprise that has completed a lump-sum foreign capital investment with an amount (excluding loans from foreign shareholders) of more than 10 million USD (or other equivalent currency) in Liwan District shall be awarded at 8 per-mille of the investment’s equivalent value of RMB on the day of the investment. The amount of the reward for a single enterprise per year shall be no more than 5 million RMB.

Article 6. [Business Development Reward] A wholesale enterprise with an annual operating income of more than 1 billion RMB, a retail enterprise with an annual operating income of more than 250 million RMB, a service enterprise with an annual operating income of more than 100 million RMB, an accommodation and catering enterprise with an annual operating income of more than 100 million RMB, an industrial enterprise with an annual operating income of more than 100 million RMB, and a construction enterprise with an annual operating income of more than 500 million RMB shall be awarded a maximum of 10 million RMB by grade in accordance with the the enterprise’s industrial development scale and growth rates.

Article 7. [Office Subsidy] A newly-introduced wholesale enterprise with an annual operating income of more than 1 billion RMB, a retail enterprise with an annual operating income of more than 250 million RMB, a service enterprise with an annual operating income of more than 100 million RMB, an accommodation and catering enterprise with an annual operating income of more than 100 million RMB, an industrial enterprise with an annual operating income of more than 100 million RMB, and a construction enterprise with an annual operating income of more than 500 million RMB shall be subsidized in a lump sum 30 percent of their total rent for self-use offices in Liwan District in the year, with a maximum of 1 million RMB. The specific rent criteria refer to the housing rental market prices in the location, the region, and for the current year, as published annually by the municipal housing administration department.

A wholesale enterprise with an annual operating income of more than 20 billion RMB, a retail enterprise with an annual operating income of more than 2 billion RMB, a service enterprise with an annual operating income of more than 2 billion RMB, an accommodation and catering enterprise with an annual operating income of more than 2 billion RMB, an industrial enterprise with an annual operating income of more than 2 billion RMB, and a construction enterprise with an annual operating income of more than 10 billion RMB shall be subsidized in a lump sum at 1,000 RMB per square meter for building or purchasing self-use office properties in Liwan District in the year it reaches the operating income and the year after, with a maximum of 5 million RMB.

Enterprises that meet both of the above circumstances shall only apply for either office rental or purchase subsidies (but not both).

Article 8. [Brand Promotion Reward] A Liwan District high-quality enterprise listed for the first time as one of China’s Top 500 Private Firms, China’s Top 500 Manufacturing Enterprises, or China’s Top 500 Service Enterprises shall be awarded 1.5 million RMB; as one of China’s Top 500 Enterprises, 3 million RMB; and as one of the Global 500 company, 10 million RMB.

If more than one of the above recognitions are won in a year, the reward will be given according to the highest one. If a kind of recognition is won more than once, there shall be only one reward. No reward shall be given for any new recognition lower than the highest recognition won by the enterprise previously. If a recognition won in the previous year is upgraded, the balance between the rewards for the two grades shall be offered.

Article 9. [Support for Household Registration and Education] People introduced by an enterprise from other provinces or overseas who are in need of permanent household registration or a residence permit in the municipality, may apply according to procedures. Should the application be approved, those approved shall be issued permanent household registration or residence permits for themselves, their spouses, and their minor children. School-aged children with permanent household registration or residence permits authorized by Liwan District shall be regarded as school district students according to the law.

For a high-quality enterprise that created industrial development benefits of more than 1 million RMB for the district in the previous complete fiscal year, 1 compulsory education enrollment offer equivalent to that for students with household registration in Liwan District shall be granted to the children of its employees without household registration in the municipality. On top of that, for every additional 1 million RMB in industrial development benefits created by the enterprise for the district in the previous complete fiscal year, there shall be 1 more enrollment offer equivalent to that for students with household registration in Liwan District. For an enterprise newly included in the statistical management of enterprises above the designated size, 1 compulsory education enrollment offer equivalent to that for students with household registration in Liwan District shall be granted to the children of its employees without household registration in the municipality. Qualified enterprises may apply to the Liwan District Commerce and Investment Promotion Bureau. An applicant may file three schools of enrollment intention. After the Liwan District Commerce and Investment Promotion Bureau confirms the qualifications and submits them to the District Joint Meeting for Investment Promotion and Stabilization for consideration and approval, the Liwan District Education Bureau shall coordinate and arrange primary and secondary school vacancies within the district.

If an enterprise belongs to the modern industrial system that Liwan District promotes and has such a need but does not meet the above requirements for industrial output for the time being, the applicant may file three schools of enrollment intention. After the Liwan District Commerce and Investment Promotion Bureau confirms their qualifications and submits them to the District Joint Meeting for Investment Promotion and Stabilization for consideration and approval, the Liwan District Education Bureau shall coordinate and arrange primary and secondary school vacancies within the district.

Article 10. [Investment Introduction Incentive] Introducers who play a major and key role in investment projects (including but not limited to domestic and foreign enterprises, social groups, intermediaries, and other economic organizations, as well as natural persons; for a group of more than one introducer, one of them shall be designated by the project as the representative) are encouraged to assist Liwan District in investment promotion. An introducer shall be awarded 50 thousand RMB in a lump sum for introducing an enterprise to register in Liwan District and be included in the statistical management of enterprises above the designated size in the year of registration or the year after. The total reward amount in one year shall be no more than 1 million RMB.

An introducer shall be awarded 300 thousand RMB in a lump sum for introducing a Global 500 company or a large central state-owned enterprise (group) to register and set up a project headquarters in Liwan District; 200 thousand RMB in a lump sum for introducing one of China’s Top 500 Enterprises to register and set up a project headquarters in Liwan District; and 100 thousand RMB in a lump sum for introducing one of China’s Top 500 Manufacturing Enterprises, China’s Top 500 Service Enterprises, or China’s Top 500 Private Firms to register and set up a project headquarters in Liwan District. A project with more than one of the above qualifications shall be awarded only once in accordance with the highest qualification.

Article 11. [Key Talents Allowance] A high-quality enterprise supported by the above terms of these Measures may designate up to 70 percent of the total amount awarded by Liwan District to the enterprise as an allowance for the enterprise’s key talents.

Article 12. [Special Notes] A group enterprise may apply for corresponding incentives with the operating income and industrial output of its subsidiaries to be added to the calculation as a condition for the application. New branches and name changes of existing enterprises in Liwan District are not applicable to the scope of incentives under these Measures.

All references herein to monetary units are stated in Renminbi, unless otherwise specified. All amounts with up to, a maximum of, more than, or no more than include the number itself.

Article 13. [No Repetitive Granting] A project or item applicable to these Measures and other policies or regulations of the district (including policies and regulations of superior departments on support or funds provided by the district) shall be offered only and solely the fund of the largest amount, unless otherwise specified.

Article 14. [Definitions] The terms in these Measures are defined as follows:

(I) A Global 500 company refers to a company in the Global 500 list published by Fortune magazine in the previous one year or its directly controlled subsidiary that files an application.

(II) A large central state-owned enterprise (group) refers to an enterprise managed by the State-owned Assets Supervision and Administration Commission of the State Council or other ministries or commissions since the previous one year or its directly controlled subsidiary that files an application.

(III) One of China’s Top 500 Enterprises refers to an enterprise in the China’s Top 500 Enterprises list released by the China Enterprise Confederation and China Enterprise Directors Association for the previous one year or its directly controlled subsidiary that files an application.

(IV) One of China’s Top 500 Private Firms refers to an enterprise in the China’s Top 500 Private Firms list released by All-China Federation of Industry and Commerce for the previous one year or its directly controlled subsidiary that files an application.

(V) One of China’s Top 500 Manufacturing Enterprises refers to an enterprise in the China’s Top 500 Manufacturing Enterprises list released by the China Enterprise Confederation and China Enterprise Directors Association for the previous one year or its directly controlled subsidiary that files an application.

(VI) One of China’s Top 500 Service Enterprises refers to an enterprise in the China’s Top 500 Service Enterprises list released by the China Enterprise Confederation and China Enterprise Directors Association for the previous year or its directly controlled subsidiary that files an application.

(VII) An enterprise above the designated size refers to an industrial enterprise with annual revenue of more than 20 million RMB, a qualified construction enterprise, a real estate development and operation enterprise engaging in development and operation activities, a wholesale enterprise with annual revenue of more than 20 million RMB from its main business, a retail enterprise with annual revenue of more than 5 million RMB from its main business, an accommodation and catering enterprise with annual revenue of more than 2 million RMB from its main business, or a service enterprise with annual revenue designated according to its segment.

(VIII) The modern industrial system refers to a modern industrial system that focuses on modern urban industries, with common progress in productive services and commerce.

Article 15. [Legal Liabilities] Any applicant (entity or individual) shall ensure the truthfulness and validity of the application materials and make a written warranty. Competent departments or institutions shall withdraw all the rewards, concessions, and subsidies granted and suspend the granting after ascertaining the facts of obtaining rewards, concessions, or subsidies by improper means, such as concealment, falsification, or forgery, failing to use the rewards, concessions, or subsidies in accordance with the regulations and the agreed purposes, refusing to cooperate with the performance evaluation, supervision, and inspection of the support funds, or breaching the warranty. If such a case constitutes a crime, the criminal responsibility shall be investigated according to the law.

Article 16. [Miscellaneous Regulations] These Measures shall come into effect on the date of issuance and shall be valid for 3 years. The Measures of Liwan District of Guangzhou Municipality for Further Promoting the Development of High-Quality Enterprises (Normative Document No 4 [2021] of Liwan District People’s Government Office of Guangzhou Municipality) shall be abrogated simultaneously.

Support and reward items released from December 7, 2020, to the issuance of these Measures shall be implemented with reference to these Measures.
